We booked our annual Christmas Vacation to Lake Tahoe, we are supposed to leave Jan 3rd and stay through the 8th.
California did a stay at home order starting Dec 6th until certain regions had at least 15% ICU availability. The region that South Lake Tahoe falls in is the Greater Sacramento Region, currently at 16.6% ICU availability. Link:Map
Turnkey, who we booked through, cancelled our reservation even though the stay at home order is not in effect on our dates. Our lease agreement with them says they can cancel due to a shutdown, but it isn’t shutdown. Meanwhile, they say we can not get a refund and can not transfer the credit to another property. This particular property isn’t available until April, post ski season.
TurnKey has been 100% unwilling to work with us, the stay is $7500 and they are basically saying we can use it next winter. Do I have any legal recourse here!?
Btw, we own a vacation rental and have refunded 3 different stays last minute due to COVID.
