Why doesn't Ntambwe just sue?

I know it's been mentioned in other threads but I figured I would start another one focused on it. It seems the NCAA will cave under the slightest bit of legal pressure, especially when it comes to athletes eligability. Why wouldn't Ntambwe just sue? If he loses, he's right back where he is today.
