Hoping someone has some knowledge on this before seeking an attorney. My family has 1 section of land that is part of 3 section combined to form a hunting club out in west Texas. This club was formed in the 80’s and at some point one member became relatively unhappy and keeps his distance.(wife related). I grew up mule deer, javelina, dove and quail hunting it. Finding arrowheads in old caves that were at one time inhabited by local tribes. Even has an original “highway” that runs through it when the most high tech transportation was a stagecoach.
However, he has bought the surrounding property that includes the private road to get to the 3 sections and our 1 section of land. We are fairly certain he is about to make a move trying to prevent anyone in the club from using the private road to reach our land/the hunting club.
My question is does anyone know if that is legal or what statute/law to look at for it? He is still a major share holder of the hunting club as well, so effectively he would only be choosing certain people to prohibit and not the entire entity as he is still part of it. To our knowledge he would also still plan on letting other land owners past/around our land use the private road still as well.
My Granddad bought the land and this is crushing to my Dad so trying to help him figure things out before attorneys get involved. The other guy will straight money whip the rest of the group with attorneys, my Dad included. So really hoping to avoid it.
